{"id":7337,"date":"2012-04-04T09:55:45","date_gmt":"2012-04-04T15:55:45","guid":{"rendered":"http:\/\/update.legislature.ne.gov\/?p=7337"},"modified":"2013-03-11T13:01:30","modified_gmt":"2013-03-11T19:01:30","slug":"immunity-for-employer-referrals-passes","status":"publish","type":"post","link":"https:\/\/update.legislature.ne.gov\/?p=7337","title":{"rendered":"Immunity for employer referrals passes"},"content":{"rendered":"<p>Employers providing job references for a current or former employee will receive civil immunity under a bill passed by the Legislature April 4.<\/p>\n<p>LB959, introduced by Fremont Sen. Charlie Janssen, provides immunity to a current or former employer who provides certain information to a prospective employer only upon written consent of the prospective employee.<\/p>\n<p>A consent form will be provided during the application process and will be valid only for the length of time that the application is considered active by the prospective employer but no longer than six months.<\/p>\n<p>Information that may be provided includes:<br \/>\n\u2022 employment date and duration;<br \/>\n\u2022 job description and duties;<br \/>\n\u2022 pay rate and wage history;<br \/>\n\u2022 attendance information;<br \/>\n\u2022 drug and alcohol test results;<br \/>\n\u2022 threatening or harassing behavior;<br \/>\n\u2022 whether the employee is eligible for rehire; and<br \/>\n\u2022 the most recent written performance evaluation, if provided to the employee.<\/p>\n<p>An employer providing information pursuant to a written consent will be immune from civil liability and presumed to be acting in good faith.
