{"id":5783,"date":"2012-01-20T16:31:36","date_gmt":"2012-01-20T22:31:36","guid":{"rendered":"http:\/\/update.legislature.ne.gov\/?p=5783"},"modified":"2013-03-11T14:08:49","modified_gmt":"2013-03-11T20:08:49","slug":"bill-would-prevent-frivolous-lawsuits-from-inmates","status":"publish","type":"post","link":"https:\/\/update.legislature.ne.gov\/?p=5783","title":{"rendered":"Bill would prevent frivolous lawsuits from inmates"},"content":{"rendered":"<p>Inmates would be prevented from filing frivolous lawsuits at public expense under a bill discussed by the Judiciary Committee Jan. 20.<\/p>\n<p>LB793, introduced by Omaha Sen. Scott Lautenbaugh, would place restrictions on inmates with a history of filing frivolous lawsuits. He said the bill would save taxpayer money and unclog the state court system.<\/p>\n<p>\u201cSome prisoners have abused the filing process in the past,\u201d Lautenbaugh said. \u201cOne gentleman has filed over 600 lawsuits.\u201d<\/p>\n<p>Under the bill, any inmate who has previously filed three civil lawsuits deemed by a court to be frivolous would be prohibited from filing a civil case at the public\u2019s expense. The inmate could continue to file civil suits at his or her personal expense.<\/p>\n<p>Exceptions to the rule would include inmates who could prove an imminent danger of bodily harm or criminal appeals. If signed into law, the \u201cthree-strike\u201d rule would apply only to lawsuits filed after the adoption of the law.<\/p>\n<p>Warren Whitted, Nebraska State Bar Association president, testified in support of LB793.
