The law requires a landowner to effectively manage prairie dog colonies on his or her property to prevent them from expanding to adjacent property if the owner objects to the expansion. If a landowner does not provide evidence that a colony is being managed within 60 days of a county board\u2019s notice, the county may enter upon the property to manage the prairie dogs.<\/p>\n
The landowner would be responsible for any expenses, and unpaid assessments would become a lien on the property. Landowners who do not comply also could receive a fine of up to $1,500. The law allows a county to file a foreclosure suit to recover the debt.<\/p>\n
Omaha Sen. Ernie Chambers, sponsor of LB449, said the act violates property owners\u2019 rights by allowing government agents to come onto their land without notice when a neighbor makes an unverified complaint about prairie dogs on the property.<\/p>\n
\u201cPeople can come onto your property, they can damage it, they can spread poison\u2014without any court involvement, without giving you notice,\u201d he said. <\/p>\n
Sen. Laura Ebke of Crete supported the bill. Whether prairie dogs are a nuisance or not, she said, landowners do not have the right to tell others that they cannot have prairie dogs on their property. <\/p>\n
\u201cThe appropriate role of government is to protect life, liberty, the pursuit of happiness and property,\u201d Ebke said. \u201cI think my conservative colleagues have long believed that\u2014they ought to jump in line on this one.\u201d<\/p>\n
North Platte Sen. Mike Groene also supported the bill. He said current law allows landowners to seek help from the Animal and Plant Health Inspection Service of the U.S. Department of Agriculture to control prairie dogs and other nuisance animals. Groene agreed that the current law infringes on Nebraskans\u2019 privacy, property and due process rights. <\/p>\n
\u201cWhen I get a speeding ticket, I go to court in front of a judge,\u201d he said. \u201cThere\u2019s no judge here, or court.\u201d<\/p>\n
Sen. Tyson Larson of O\u2019Neill opposed repealing the current law. Government\u2019s role, he said, should be to protect individuals\u2014and their property rights\u2014from other individuals.<\/p>\n
\u201cBy not having something like [the current law], you are allowing another individual\u2019s decisions to blatantly harm my property and my property rights,\u201d Larson said.<\/p>\n
Sen. Dan Hughes of Venango also opposed the bill. He said the current law has never been used, but its existence forces landowners to settle disputes about unmanaged prairie dog colonies. <\/p>\n
\u201cI agree with Sen. Groene,\u201d Hughes said. \u201cWhat he wants to do on his property is fine, but when it begins to encroach upon my property, devaluing my property\u2014which is what prairie dogs do\u2014then I have a problem.\u201d <\/p>\n
