{"id":17102,"date":"2015-04-13T12:03:56","date_gmt":"2015-04-13T18:03:56","guid":{"rendered":"http:\/\/update.legislature.ne.gov\/?p=17102"},"modified":"2015-04-13T12:03:56","modified_gmt":"2015-04-13T18:03:56","slug":"borrowing-authority-for-municipalities-amended-advanced-2","status":"publish","type":"post","link":"https:\/\/update.legislature.ne.gov\/?p=17102","title":{"rendered":"Borrowing authority for municipalities amended, advanced"},"content":{"rendered":"<p>Cities and towns in Nebraska would have the express authority to borrow funds to purchase property or construct improvements under a bill advanced from select file April 13.<\/p>\n<p>LB152, introduced by the Urban Affairs Committee, would allow municipalities to borrow from state- or federally-chartered banks, savings banks, building and loan associations and savings and loan associations.<\/p>\n<p>Bellevue Sen. Sue Crawford, chairperson of the committee, brought an amendment on select file that made several changes to the bill.<\/p>\n<p>The amendment authorizes direct borrowing by resolution as well as ordinance and clarifies that municipalities could use direct borrowing to refinance loans at a lower rate. The amendment also removed the term \u201csignificant\u201d in reference to taxpayer savings over traditional bond financing as a requirement for direct borrowing.<\/p>\n<p>Crawford said concerns were raised after the bill was discussed on general file that the term was ambiguous and possibly could leave municipalities vulnerable to litigation.<\/p>\n<p>Under the amended bill, funds could be borrowed for any purpose for which a municipality is authorized by law to purchase property or fund improvements. Loans would not be restricted to a single year and could be repaid in installments.<\/p>\n<p>The ability of municipalities to borrow directly from financial institutions to cases in which financing the purchase of property or construction of improvements:<br \/>\n\u2022\twould be impractical;<br \/>\n\u2022\tcould not be completed within the time restraints facing the municipality; or<br \/>\n\u2022\twould generate taxpayer savings over traditional bond financing.<\/p>\n<p>The bill also includes public notice requirements for direct borrowing from a financial institution and caps the total amount of indebtedness from direct borrowing to 10 percent of the municipal budget for a city or 20 percent of the municipal budget for a village.<\/p>\n<p>Following adoption of the Crawford amendment on a 30-0 vote, the bill advanced to final reading by voice vote.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Cities and towns in Nebraska would have the express authority to borrow funds to purchase property or construct improvements under<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"colormag_page_container_layout":"default_layout","colormag_page_sidebar_layout":"default_layout","jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":false,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[23],"tags":[106],"class_list":["post-17102","post","type-post","status-publish","format-standard","hentry","category-urban-affairs","tag-sen-sue-crawford"],"jetpack_publicize_connections":[],"jetpack_featured_media_url":"","jetpack_sharing_enabled":true,"_links":{"self":[{"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/posts\/17102","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=17102"}],"version-history":[{"count":2,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/posts\/17102\/revisions"}],"predecessor-version":[{"id":17104,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/posts\/17102\/revisions\/17104"}],"wp:attachment":[{"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=17102"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=17102"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=17102"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
