{"id":16431,"date":"2015-02-19T11:20:26","date_gmt":"2015-02-19T17:20:26","guid":{"rendered":"http:\/\/update.legislature.ne.gov\/?p=16431"},"modified":"2015-02-19T11:20:26","modified_gmt":"2015-02-19T17:20:26","slug":"home-care-consumer-protections-proposed","status":"publish","type":"post","link":"https:\/\/update.legislature.ne.gov\/?p=16431","title":{"rendered":"Home care consumer protections proposed"},"content":{"rendered":"<p>The Health and Human Services Committee heard testimony Feb. 18 on a bill that seeks to enhance protections for individuals who receive in-home care services.<\/p>\n<p>Omaha Sen. Heath Mello, sponsor of LB607, said the measure was the result of a recommendation from the Legislature&#8217;s Aging Nebraskans Task Force. The bill would create the Home Care Consumer Bill of Rights, which would apply to individuals 60 and older, or those 18 and older with a disability, who receive home care services.<\/p>\n<p>Mello said he intended to amend the bill\u2019s language to include minors who receive in-home care services.<\/p>\n<p>Among other provisions, a consumer of home care services would have the right to:<br \/>\n\u2022\trefuse service;<br \/>\n\u2022\tparticipate in the approval of services and any changes in service;<br \/>\n\u2022\tfreedom from exploitation;<br \/>\n\u2022\tfreedom of choice in service providers; and<br \/>\n\u2022\tinformation on rights and responsibilities in an agreement between the consumer and the service provider.<\/p>\n<p>A company that fails to provide the information to consumers receiving in-home services as required by LB607 would be subject to a Class V misdemeanor.<\/p>\n<p>Mello said it is a growing concern that seniors and others often employ caregivers without realizing that they are considered contract employees, which can involve significant liabilities.<\/p>\n<p>\u201cLB607 would provide increased clarity and responsibility moving forward for both consumers and providers,\u201d Mello said.<\/p>\n<p>Michaela Valentin, representing Home Instead Senior Care, testified in support of the bill. If a caregiver is a contract employee\u2014rather than an employee of an agency\u2014the consumer is responsible for taxes, payroll and scheduling and has no recourse for theft or property damage, she said.<\/p>\n<p>Kristi Benning, operations manager for Right at Home in Omaha, agreed.
