{"id":14560,"date":"2014-02-07T17:48:55","date_gmt":"2014-02-07T23:48:55","guid":{"rendered":"http:\/\/update.legislature.ne.gov\/?p=14560"},"modified":"2014-02-07T18:06:13","modified_gmt":"2014-02-08T00:06:13","slug":"definition-of-innocent-third-party-discussed","status":"publish","type":"post","link":"https:\/\/update.legislature.ne.gov\/?p=14560","title":{"rendered":"Definition of innocent third party discussed"},"content":{"rendered":"<p>Passengers in vehicles fleeing law enforcement could be charged with a crime under legislation heard by the Judiciary Committee Feb 7.<\/p>\n<p>LB881, introduced by Syracuse Sen. Dan Watermeier, would codify the judicial definition of \u201cinnocent third party\u201d to mean any person who has not promoted, provoked or persuaded a driver to engage in flight from law enforcement and one who is not sought to be apprehended in the fleeing vehicle.<\/p>\n<p>The bill also would expand the definition to acknowledge circumstances when a passenger in a fleeing vehicle should not be considered an innocent third party. This could occur when it is evident that the passenger was engaged in illegal activity or entered into the vehicle without coercion or knowing that the driver was under the influence of alcohol or drugs.<\/p>\n<p>Watermeier said he introduced the bill because \u201cinnocent third party\u201d is not defined in statute.
