{"id":10762,"date":"2013-03-14T11:30:27","date_gmt":"2013-03-14T17:30:27","guid":{"rendered":"http:\/\/update.legislature.ne.gov\/?p=10762"},"modified":"2013-09-06T08:26:17","modified_gmt":"2013-09-06T14:26:17","slug":"bill-would-restrict-sex-offender-residency-near-parks","status":"publish","type":"post","link":"https:\/\/update.legislature.ne.gov\/?p=10762","title":{"rendered":"Bill would restrict sex offender residency near parks"},"content":{"rendered":"<p>The Judiciary Committee heard testimony March 13 on a bill meant to restrict certain sex offenders from living near parks.<\/p>\n<p>The state\u2019s Sexual Predator Residency Restriction Act currently allows a political subdivision to adopt regulations to restrict sexual predators from living within 500 feet of a school or child care facility.<\/p>\n<p>LB473, sponsored by Hoskins Sen. Dave Bloomfield, would extend that authority to restrict residency near parks.<\/p>\n<p>The bill defines a park is defined as a parcel of ground or a facility established by a political subdivision for recreational use by the public that covers at least 2,500 square feet.<\/p>\n<p>The bill also expands the definition of sexual predator of children to include a sex offender who has been convicted of a crime that involved the penetration or direct genital touching of, oral to anal contact with or oral to genital contact with a person younger than 13 years old.<\/p>\n<p>The residency restriction would not apply if a sexual predator had established a residence before the bill\u2019s effective date and had not moved from that residence, or if a park triggering the restriction is established after the effective date.<\/p>\n<p>Bloomfield said the bill was necessary because South Sioux City experienced an influx of sex offenders following passage of a similar bill in Iowa.<\/p>\n<p>\u201cThis bill does nothing more than add parks to the list of places that can be restricted,\u201d he said.<\/p>\n<p>Ed Mahon of the South Sioux City Police Department testified in support of the bill, saying it would address concerns of parents in the area.<\/p>\n<p>Between five and 10 individuals on Iowa\u2019s sex offender registry recently have moved to South Sioux City due to Nebraska\u2019s less stringent residency guidelines, he said.<\/p>\n<p>Eric Baird of Papillion testified in opposition, saying residency restrictions create displacement of individuals on the sex offender registry without providing meaningful protection for children.<\/p>\n<p>\u201cIt\u2019s a symbolic law, not an effective law,\u201d he said.<\/p>\n<p>The committee took no immediate action on the bill.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Judiciary Committee heard testimony March 13 on a bill meant to restrict certain sex offenders from living near parks.<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"colormag_page_container_layout":"default_layout","colormag_page_sidebar_layout":"default_layout","jetpack_post_was_ever_published":false,"_jetpack_newsletter_access":"","_jetpack_dont_email_post_to_subs":false,"_jetpack_newsletter_tier_id":0,"_jetpack_memberships_contains_paywalled_content":false,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":false,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"font":"","enabled":false},"version":2}},"categories":[13],"tags":[69],"class_list":["post-10762","post","type-post","status-publish","format-standard","hentry","category-judiciary","tag-sen-dave-bloomfield"],"jetpack_publicize_connections":[],"jetpack_featured_media_url":"","jetpack_sharing_enabled":true,"_links":{"self":[{"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/posts\/10762","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=10762"}],"version-history":[{"count":6,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/posts\/10762\/revisions"}],"predecessor-version":[{"id":12799,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=\/wp\/v2\/posts\/10762\/revisions\/12799"}],"wp:attachment":[{"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=10762"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=10762"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/update.legislature.ne.gov\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=10762"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
